Question(s) about mobile phone GPS?

I want to buy an unlocked HTC Fuze.My reason for this particular choice is the assumption of its GPS functions working how I imagine they would.

I want to use the GPS on the phone but not through ATT basically.
I assume this can be done by using software such as Garmins mobile XT software and using it just as if I went out and bought an automotive GPS.This is the software’s purpose if im not mistaken.
The question :D oes ATT block GPS in the phone unless subscribed to some service?
I assume they would some how, knowing how wireless providers are criminals.
